Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the http://qcapi.harishmadabushi.com/ website (the “Service”) operated by Harish Tayyar Madabushi (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

YOUR API KEY
In order to use the Question Classification API, you must obtain appropriate API credentials (an “API Key”) via registration on harishmadabushi.com. You may not reveal your API Key to anyone else and must keep your API Key secure. You are solely responsible for maintaining the confidentiality and security of your API Key, and for all activities that occur through the use of your API Key. You agree to immediately notify us of any security breach of your API Key. You accept all risks of unauthorized use of your API Key. We reserves the right to deny, deactivate, or terminate your API Key for any reason at our discretion and we shall not be responsible for any losses arising out of the unauthorized use of your API Key.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Harish Tayyar Madabushi.

Harish Tayyar Madabushi has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Harish Tayyar Madabushi shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Security

You may not use your API Key or the Services to test or undermine the security of the Services. You will not and will not attempt to (i) interfere with, modify or disable any features, functionality or security controls of the Services or Question Classification API, (ii) defeat, avoid, bypass, remove, deactivate or otherwise circumvent any protection mechanisms incorporated into the Service, or (iii) reverse engineer, decompile, disassemble or derive source code, underlying ideas, algorithms, structure or organizational form from the Services or Question Classification API.

You are solely responsible for your conduct (and the conduct of anyone who uses your API Key to access the Services). You will comply with any limitations imposed by us on the frequency of access and calls to and use of the Question Classification API and/or any additional programmatic limitations on the Question Classification API.

You will immediately report to us any security flaws you discover in any of the Services. We reserves the right, at our sole discretion, to determine what constitutes a security flaw. Failure to report such flaws, particularly prior to public disclosure, shall be considered a material breach of this Agreement.

Monitoring

We retain the right, but not the obligation, to monitor your use of the Services and the Question Classification API for any reason or no reason, including to ensure your compliance with these Terms and Conditions.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

DISCLAIMER OF WARRANTIES; LIMITATIONS OF LIABILITY

WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME WE MAY REMOVE THE SERVICES FOR INDEFINITE PERIODS OF TIME, OR CANCEL THE SERVICES AT ANY TIME, WITHOUT NOTICE TO YOU.

WE SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE SERVICES, BUT YOU AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK, AND WE HEREBY DISCLAIM ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.

INDEMNIFICATION

YOU AGREE, TO THE FULLEST EXTENT PERMITTED BY LAW, TO INDEMNIFY AND HOLD HARMLESS US AND OUR AFFILIATES, AGENTS, CONTRACTORS, PRINCIPALS, AND LICENSORS FROM AND AGAINST ANY CLAIMS, DAMAGES, PAYMENTS, DEFICIENCIES, FINES, JUDGMENTS, SETTLEMENTS, LIABILITIES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES, COSTS, PENALTIES, INTEREST, AND DISBURSEMENTS) ARISING OUT OF OR RELATED TO YOUR BREACH (OR ALLEGED BREACH) OF THESE TERMS AND CONDITIONS, THE AGREEMENTS AND POLICIES, ANY SERVICE TERMS, YOUR DEVELOPMENT AND DEPLOYMENT OF ANY SOFTWARE, YOUR USE OF THE SERVICES (OR ANY THIRD PARTY USING YOUR ACCOUNT), INCLUDING THE QUESTION CLASSIFICATION API, ANY USER CONSENT OR FEEDBACK, OR THE VIOLATION (OR ALLEGED VIOLATION) OF THE RIGHTS OF ANY THIRD PARTY BY YOU OR ANY THIRD PARTY USING YOUR ACCOUNT.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
